Acceptable Usage Policy

This Acceptable Use Policy (“AUP”) forms an integral part of the Master Services Agreement (“Agreement”) between Arriga International Limited (“Provider”) and the Customer. Capitalised terms used but not defined herein shall have the meanings ascribed to them in the Agreement.

The Customer agrees to use the Services, Network, and any Leased Resources (including IPv4 Addresses and ASN) in compliance with this AUP, all applicable laws, regulations, and policies of relevant Regional Internet Registries (RIRs) such as APNIC, RIPE NCC, ARIN, LACNIC, and AFRINIC.

  1. Prohibited Activities The Customer shall not, and shall ensure that its Affiliates, end-users, and any third parties using the Services through the Customer do not: a. use the Services for any unlawful, abusive, or fraudulent purpose, including but not limited to violation of intellectual property rights, privacy laws, or export control regulations; b. transmit, distribute, or store any material that is defamatory, obscene, indecent, harassing, threatening, or otherwise objectionable; c. engage in spamming, mail bombing, denial-of-service attacks, or any activity that interferes with or disrupts the Services, Network, or third-party networks (including excessive or unsolicited traffic); d. forge headers, manipulate identifiers, or otherwise impersonate any person or entity; e. host or distribute malware, viruses, worms, Trojan horses, or any other harmful code; f. engage in phishing, pharming, or any form of fraudulent activity designed to obtain sensitive information; g. use Leased Resources in a manner that violates RIR policies, including but not limited to inaccurate WHOIS data, unauthorized sub-allocation, or use inconsistent with the justification provided to the RIR; h. use the Services to facilitate or support activities that could lead to blacklisting of IP addresses or ASN by reputable blocklists (e.g., Spamhaus, SORBS); i. resell, sub-lease, or otherwise transfer Leased Resources without the Provider’s prior written consent; j. conduct network scanning, probing, or vulnerability testing on third-party systems without authorisation.
  2. Network Integrity and Security The Customer shall: a. maintain the security of its Customer Equipment and systems connected to the Provider’s Network; b. promptly notify the Provider of any security incidents, breaches, or misuse affecting the Services; c. cooperate with the Provider in investigating and mitigating any abuse or security issues.
  3. Compliance with Laws and Regulations The Customer shall comply with all applicable laws, including but not limited to data protection laws (GDPR, Hong Kong Personal Data (Privacy) Ordinance), anti-spam regulations (e.g., CAN-SPAM, EU e-Privacy Directive), and export control/sanctions laws.
  4. Enforcement a. The Provider reserves the right to monitor the use of the Services for compliance with this AUP and to investigate suspected violations. b. In the event of a violation of this AUP, the Provider may, at its sole discretion and without prior notice:
  • suspend or terminate the affected Services or Leased Resources;
  • remove or block offending content;
  • take any other action necessary to protect the Network, other customers, or third parties. c. The Provider may report violations to law enforcement or relevant authorities and cooperate with investigations. d. The Customer shall indemnify the Provider against any claims, losses, or liabilities arising from the Customer’s breach of this AUP.
  • Amendments The Provider may amend this AUP from time to time by posting the revised version at https://www.arriga.hk/aup. Continued use of the Services after such amendments constitutes acceptance of the revised AUP. Material changes will be notified to the Customer in writing with at least 30 days’ notice.
  • No Waiver Failure by the Provider to enforce any provision of this AUP shall not constitute a waiver of such provision.

By using the Services, the Customer acknowledges that it has read, understood, and agrees to be bound by this AUP.
